Who must comply with the mandatory workplace safety and loss prevention consultation under Workers' Compensation Reform?
Employers who have an annual payroll of at least $800,000 and a most recent experience modification rate of over 1.2 must have the mandatory workplace safety and loss prevention consultation or face a 5% surcharge on their manual rate premium for the next ensuing policy period and an additional 5% surcharge for every year of non-compliance. The employer’s insurer would implement such surcharges.
